07/01/21 – A Terceira Turma do Tribunal Superior do Trabalho rejeitou recurso da Almaviva do Brasil Telemarketing e Informática Ltda. contra a condenação ao pagamento de indenização a uma supervisora de atendimento de Guarulhos (SP) em razão da conduta assediadora dos gestores em grupo de WhatsApp. As situações vexatórias incluíam a cobrança de retorno do banheiro, com a exposição dos empregados aos demais participantes do grupo.
Na reclamação trabalhista, a supervisora disse que, desde o início do contrato, era obrigada a permanecer em grupos de WhatsApp administrados pelos gestores, em que eram expostos os resultados e os nomes de quem não alcançava as metas semanais e divulgadas falhas como pausa, faltas e atrasos. Como supervisora, ela também era chamada a atenção nos grupos.
Assédio comprovado
O Tribunal Regional do Trabalho da 2ª Região (SP) entendeu que a conduta assediadora fora provada por declarações de uma testemunha, que confirmara que os gestores dispensavam tratamento grosseiro aos supervisores. De acordo com o depoimento, uma gestora chegou a determinar à supervisora, por mensagem no grupo, que retornasse do banheiro. A indenização foi fixada em R$ 5 mil.
Humilhação perante colegas
Para o relator do recurso de revista da Almaviva, ministro Alberto Bresciani, a sujeição da empregada à humilhação por seu superior hierárquico compromete a sua imagem perante os colegas de trabalho e desenvolve, presumidamente, sentimento negativo de incapacidade profissional. O ministro observou que, nessa circunstância, o dano moral não exige prova para sua caracterização, bastando a demonstração do fato que revele a violação do direito de personalidade para originar o dever de indenizar. No caso, ficaram evidenciados, na decisão do TRT, o dano, o nexo causal e a culpa da empregadora.
A decisão foi unânime.
